1. Who we are and what we offer

1.1 PhoneMart is operated by I Repair Dar Limited ("PhoneMart", "we", "us"), a company registered in England and Wales under company number 17455371, with its registered office at 40 Northgate, Darlington, DL1 1PP.

1.2 PhoneMart sells refurbished smartphones, tablets, laptops and related accessories directly to customers through the website at https://phonemart.uk (the "Site"). We are the seller of every Product listed on the Site. There are no third-party sellers.

1.3 These Terms of Use set out the rules for accessing and using the Site and your account. The purchase of Products is additionally governed by our Terms of Sale, which cover ordering, delivery, cancellation, returns and warranty.

1.4 These Terms apply to everyone who visits the Site, whether or not they hold an account.

1.5 We may update these Terms from time to time. The version in force is the one published on the Site at the time you use it. Please check them each time you visit.

2. Definitions

In these Terms, the following words have the meanings given below:

AccountThe personal customer account you create on the Site.
CustomerAny individual who purchases Products from PhoneMart for personal, non-business use.
ProductAny item offered for sale on the Site. Unless stated otherwise, Products are pre-owned devices that have been inspected, tested and refurbished before sale.
Product ListingThe description, condition grade, specification, price and images of a Product as shown on the Site.
ServicesEverything PhoneMart provides through the Site, including browsing, accounts, ordering, payment processing, customer support and store credit.
SiteThe website at phonemart.uk and any associated pages or applications operated by PhoneMart.
Store CreditCredit held in your Account that can be applied against future orders (see section 7).
TermsThese Terms of Use.
User / youAny person who accesses the Site for non-business purposes, with or without an Account.

3. Creating an account

3.1 To create an Account you need a valid email address and a password. By creating an Account you confirm that you have read and accept these Terms. You can download or print a copy of these Terms at any time from the Site.

3.2 Accounts are available only to individuals aged 16 or over who have the legal capacity to enter into a contract. If you are aged 16 or 17, you must have the permission of a parent or legal guardian to place an order.

3.3 You may check out as a guest without creating an Account. These Terms still apply to guest orders.

4. Rules for using the Site

4.1 Accurate information. You must provide accurate and complete information when creating an Account or placing an order, and keep it up to date.

4.2 Keeping your login secure. Your login details are personal to you. You are responsible for keeping your password confidential and for restricting access to the devices you use to log in. If you believe someone else has accessed your Account, change your password immediately and contact us at [email protected].

4.3 One account per person. You may hold only one Account unless we agree otherwise in writing. If we close your Account under section 8.2, you may not open a new one without our permission.

4.4 Prohibited conduct. You must not:

  • post reviews, comments or other content that is false, misleading, defamatory, abusive, discriminatory or otherwise unlawful;
  • harass other Users or attempt to access their Accounts or personal information;
  • collect data about other Users, whether manually or by automated means;
  • use any bot, crawler, scraper, script or similar tool to extract data from the Site;
  • interfere with, disrupt or attempt to compromise the security or operation of the Site;
  • use the Site for any commercial purpose, including buying Products for resale, without our written consent.

4.5 Intellectual property. All content on the Site, including text, images, logos, product descriptions, condition grading criteria, design, code and databases, belongs to PhoneMart or its licensors and is protected by copyright, trade mark and other intellectual property laws. You may not copy, reproduce, modify, distribute or commercially exploit any part of the Site without our prior written permission. Brand names and trade marks of device manufacturers appear on the Site for identification only; PhoneMart is not affiliated with or endorsed by those manufacturers unless expressly stated.

5. Products, services and pricing

5.1 What we provide. PhoneMart provides access to the Site, an Account, secure online checkout, order tracking, customer support and after-sales service for the Products we sell. There is no separate fee for using the Site or holding an Account.

5.2 Products and condition grades. Every Product is inspected and tested before listing. Each Product Listing shows a condition grade (for example Fair, Good, Excellent or Premium) together with the criteria that grade represents, including minimum battery health where applicable. The grade describes cosmetic condition only; all Products are fully functional regardless of grade. Unless stated otherwise, Products are network-unlocked and supplied with a compatible charging cable. Original packaging and other accessories are not included unless the Product Listing says so.

5.3 Pricing. All prices are shown in pounds sterling and include VAT. Standard delivery is free; express delivery is charged at a flat rate shown at checkout before you confirm your order. We may change prices at any time, but changes will not affect orders already confirmed.

5.4 Availability. Refurbished stock is limited and each unit is unique. If a Product becomes unavailable after you order, we will tell you promptly and issue a full refund.

5.5 Warranty and your legal rights. Products come with a 24-month PhoneMart warranty covering functional defects, as described in our Warranty Policy and Terms of Sale. This is in addition to, and does not affect, your statutory rights under the Consumer Rights Act 2015. Products are sold with the condition described in the Product Listing; cosmetic wear consistent with the stated grade is not a defect.

5.6 Cancellation and returns. As a consumer buying online, you have the right to cancel your order for any reason within 14 days of receiving it, under the Consumer Contracts Regulations 2013. Full details, including how to return a Product and any conditions, are in our Terms of Sale and Returns Policy.

6. Payment

6.1 Payment methods. We accept the payment methods shown at checkout, including debit and credit cards, Apple Pay, Google Pay and Klarna. Payments are processed by Stripe, which handles your card details securely; PhoneMart does not store full card numbers. Klarna is provided by Klarna Financial Services UK Limited under its own terms; any agreement to pay in instalments is between you and Klarna, is available to eligible UK residents aged 18 or over and is subject to status.

6.2 Discount codes. Unless a promotion states otherwise:

  • only one code can be used per order;
  • codes do not apply to delivery charges;
  • codes cannot be applied retrospectively to an order already placed;
  • a code with a fixed monetary value can be used once and only on an order whose total exceeds the value of the code;
  • if an order paid for with a code is refunded, the code is not reissued unless we cancelled the order ourselves;
  • codes have no cash value and cannot be exchanged for cash.

7. Store credit

7.1 We may add Store Credit to your Account, for example as a goodwill gesture, a partial refund or a promotional reward. Store Credit is shown in your Account and can be applied at checkout against future orders.

7.2 Store Credit issued as a goodwill gesture or promotion has no cash value and cannot be transferred or withdrawn. Where Store Credit represents a refund you were entitled to receive in cash, you may ask us at any time to pay it to your original payment method instead.

7.3 Store Credit expires 24 months after it is issued unless we tell you otherwise.

8. Closing your account

8.1 Closing your Account yourself. You can close your Account at any time from your Account settings or by emailing [email protected]. Closure takes effect within 30 days, provided there are no open orders, returns or warranty claims. Closing your Account does not cancel any order already placed or affect your rights under an existing warranty.

8.2 Closure by PhoneMart. We may suspend or close your Account if you breach these Terms (in particular sections 3 and 4), if you refuse to accept an updated version of these Terms, if the Account has been inactive for an extended period, or where we reasonably suspect fraud or misuse. We may also close an Account without cause on reasonable notice.

8.3 What happens on closure. We will email you to explain why the Account is being closed. Before closure, you should download any order history and invoices you need and use any Store Credit or ask us to refund any credit you are entitled to in cash. After closure you can still contact us about a previous order, but you will no longer be able to log in or place orders through the Account.

9. Contacting PhoneMart

9.1 General enquiries and complaints. PhoneMart is an online-only store. Our customer service team can be reached at [email protected], by WhatsApp chat (+44 7913 170620, 9am to 9pm UK time), or through the contact form on the Site.

9.2 Order-related queries. For questions about a specific order, delivery, returns, warranty claims or faults, please contact us through your Account or using the details above, quoting your order number. Because PhoneMart is the seller of every Product on the Site, we handle all product and after-sales issues directly.

10. Liability

10.1 The Site and Services. We work to keep the Site available and functioning, but we do not guarantee uninterrupted access. We may suspend or restrict access to carry out maintenance, repairs or improvements, or for security reasons. We are not liable for loss arising from your inability to access the Site, except where caused by our negligence.

10.2 Products. As the seller, PhoneMart is responsible for the Products we sell, including that they match their Product Listing, are of satisfactory quality and are fit for purpose, as required by the Consumer Rights Act 2015.

10.3 Your data. You are responsible for backing up and removing your personal data from any device you return to us. We are not liable for data left on returned devices, although we will erase it as part of our returns process.

10.4 Limits. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law. Subject to that, we are not liable for losses that were not foreseeable when you placed your order, for business losses, or for losses caused by your breach of these Terms.

11. Personal data

PhoneMart is the data controller for personal data collected through the Site. We use cookies and similar technologies. How we collect, use and protect your data, and how cookies are used, is explained in our Privacy Policy and Cookie Policy, both available on the Site.

12. Governing law and disputes

12.1 These Terms, and any dispute arising from them or from your use of the Site, are governed by the laws of England and Wales.

12.2 If you have a complaint, please contact us first at [email protected] or by WhatsApp chat (+44 7913 170620, 9am to 9pm UK time) so we can try to resolve it with you directly.

12.3 PhoneMart is not a member of an alternative dispute resolution (ADR) scheme. If we cannot resolve a dispute between us, you may obtain free, impartial guidance from the Citizens Advice consumer service.

12.4 You may bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country where you live.
