These Terms of Sale apply to every order you place on phonemart.uk. Together with our Terms of Use, Privacy Policy, Delivery Policy, Returns & Refunds Policy and Warranty Policy, they form the contract between you and PhoneMart. Please read them before ordering.

1. Who you are buying from
1.1 Every product on phonemart.uk is sold by I Repair Dar Limited, trading as PhoneMart, company number 17455371, registered office 40 Northgate, Darlington, DL1 1PP ("PhoneMart", "we", "us").
1.2 PhoneMart is an online-only direct retailer. There are no third-party sellers on our site, and no other business is party to your order.

2. Placing an order and when the contract is formed
2.1 You place an order by adding products to your basket, entering your details, choosing a delivery option and completing payment. Before you pay, the checkout page shows the full order summary so you can check and correct it.
2.2 When you complete payment we send an order acknowledgement email. This confirms we have received your order; it is not yet acceptance.
2.3 The contract is formed when we send you a dispatch confirmation email. Until then we may decline an order, for example because the product has become unavailable, a pricing error has occurred, our fraud checks are not satisfied, or you have breached our Terms of Use. If we decline an order after payment we refund you in full within 5 working days.
2.4 Because refurbished stock is unique, an item may occasionally be sold to another customer seconds before your order is processed. If that happens we will tell you within 1 working day and refund you, or offer an equivalent unit if one is available.
2.5 You must be at least 16 to order, and 18 to use any payment method that requires it. Orders are for personal, non-business use unless you order as a business under section 11.
3. Products and condition grades
3.1 Products are pre-owned devices that have been inspected, tested, data-wiped, repaired where necessary and graded by PhoneMart. They are not new and are not manufacturer-refurbished unless the listing says so.
3.2 Each listing states a cosmetic grade, Fair, Good, Excellent or Premium, and the minimum battery health for that grade. The grade describes appearance only; all grades pass identical functional testing. The full criteria are on our Grading Standards page and form part of the product description.
3.3 Listing photos are representative of the grade, not photographs of the individual unit.
3.4 Unless stated otherwise, devices are network-unlocked, factory-reset and supplied with a compatible charging cable. Original packaging, mains adapter and other accessories are not included.
3.5 Where a component has been replaced, the listing says so and whether the part is genuine or a compatible part.
3.6 Software: devices ship with the operating system version stated at testing. Future updates depend on the manufacturer and are not guaranteed by us.
4. Price and payment
4.1 Prices are in pounds sterling and include VAT. Standard delivery is free; express delivery is charged at a flat rate shown at checkout before you pay. There are no other fees.
4.2 Most devices are sold under the VAT margin scheme. The price you pay is VAT-inclusive, but the invoice will not show VAT as a separate line and VAT cannot be reclaimed on margin-scheme sales.
4.3 We may change prices at any time. The price you pay is the one shown when you complete checkout. If a listing shows an obvious pricing error (for example a device priced at a small fraction of its value), we may cancel the order and refund you; we will contact you first if we can.
4.4 Payment is taken in full at checkout by Stripe. We accept the cards and wallets shown at checkout. You can also choose to pay in instalments with Klarna. Klarna is provided by Klarna Financial Services UK Limited under its own terms; any agreement to pay in instalments is between you and Klarna, is available to eligible UK residents aged 18 or over and is subject to status. PhoneMart is paid in full at checkout and is not the lender.
4.5 Discount codes are subject to the conditions in our Terms of Use: one per order, not applicable to delivery, not retrospective, no cash value.
4.6 Store Credit can be applied at checkout and is deducted before payment. Refunds of orders paid partly with Store Credit are returned in the same split.
5. Delivery
5.1 We deliver to addresses in the United Kingdom, including Northern Ireland, the Scottish Highlands and Islands, the Isle of Wight, the Isle of Man and the Channel Islands.
5.2 Delivery options:

Working days are Monday to Friday excluding bank holidays. Orders placed before 3pm on a working day are dispatched that day; later orders are dispatched the next working day. Remote areas and the Channel Islands may take an additional 1 to 2 days.
5.3 All devices are sent on a tracked, signed-for service. We do not authorise leaving devices in safe places or with neighbours. If nobody is available to sign, the carrier will attempt redelivery or hold the parcel for collection.
5.4 Risk in the product passes to you when it is delivered to your address and signed for. Ownership passes when we receive payment in full.
5.5 If the product has not arrived within 5 working days of the expected delivery date, contact us. We will investigate with the carrier and, where the parcel is lost, send a replacement or refund you in full, including any delivery charge.
5.6 If we cannot deliver within 30 days of your order for reasons within our control, you may cancel for a full refund.

6. Your right to cancel (14 days)
6.1 Under the Consumer Contracts Regulations 2013 you may cancel your order for any reason within 14 days of the day you receive the product (or the last product, for orders delivered in several parcels).
6.2 To cancel, use the Return item button in My Orders, contact us by WhatsApp chat (+44 7913 170620, 9am to 9pm UK time), or email [email protected] with your order number. You may use the model cancellation form at the end of these Terms but you do not have to.
6.3 You must send the product back within 14 days of telling us you are cancelling, to I Repair Dar Limited, 40 Northgate, Darlington, DL1 1PP. You pay the cost of returning the product on a change-of-mind cancellation. We recommend a tracked, signed-for service insured to the value of the device; the product is your responsibility until we receive it. Keep proof of posting.
6.4 We refund the full price and the cost of standard delivery within 14 days of receiving the product back, or of you providing proof of posting if earlier. Express delivery charges above the standard rate are not refunded on a change-of-mind cancellation. Refunds go to the original payment method.
6.5 You are entitled to inspect and test the device as you would in a shop. If the device is returned with damage or wear beyond that, for example a cracked screen, new scratches, or a device that has been opened, we may deduct an amount reflecting the reduction in value, as the law permits. We will tell you the deduction and why before processing the refund.
6.6 The device must be returned with all account locks removed (Find My / Find My Device signed out) and factory-reset. We cannot process a refund on a locked device until the lock is removed, because we cannot verify or resell it.
7. Returns, refunds and exchanges
7.1 PhoneMart's returns period is the statutory 14 days from delivery. Full procedure is in our Returns & Refunds Policy.
7.2 Exchanges. If you want a different storage size, colour or grade, you can request an exchange instead of a refund within the 14-day period. We reserve the replacement unit, send it when the original is received and checked, and charge or refund any price difference. If the replacement is out of stock we refund you instead.
7.3 Wrong item sent. If we send the wrong product, tell us and we will send the correct one or refund you in full including delivery, at your choice. Return it by tracked post and we will reimburse the reasonable cost of postage on receipt.
7.4 Damaged on arrival. Report visible damage within 48 hours of delivery with photos of the device and packaging. We will replace or refund in full and reimburse the reasonable cost of returning the item by tracked post.
7.5 Accessories can be returned within the same 14-day period if unused and in original packaging.
8. Warranty and faulty products
8.1 Every device is covered by a 24-month PhoneMart warranty from the date of delivery, in addition to your statutory rights. Accessories carry a 12-month warranty.
8.2 The warranty covers hardware faults that arise from a defect in the device or our refurbishment, including: screen, touch and display faults; buttons and ports; speakers, microphones and cameras; connectivity (Wi-Fi, Bluetooth, mobile signal, GPS); biometric sensors; charging; and battery health falling below 80% within the warranty period.
8.3 The warranty does not cover: accidental damage (drops, cracked screens, dents); liquid damage; damage from unauthorised repair, modification, jailbreaking or rooting; cosmetic wear consistent with the grade at delivery or arising from normal use; consumables such as cases and cables after 12 months; software issues caused by apps or user settings; or faults caused by misuse.
8.4 To claim, open the order in My Orders and click Get help, or contact us. We may ask you to run basic checks first. If the fault is not resolved, we ask you to send the device to us by tracked, insured post; we reimburse the reasonable cost of postage once the fault is confirmed as covered. Our technicians diagnose the device within 3 working days of receipt and we will, at our choice, repair it, replace it with a device of the same model, storage and grade or better, or refund you. Most warranty repairs are returned within 5 to 7 working days of receipt.
8.5 Warranty repairs and replacements are free. We reimburse your reasonable postage cost for sending a covered device to us, and we pay for sending it back. A repaired or replaced device continues under the original warranty for the remainder of the 24 months.
8.6 If a device returned under warranty is found to have no fault, or the fault is excluded under 8.3, we will tell you and offer a paid repair quote. We return the device to you at our cost if you decline, but do not reimburse your postage for sending it in.
8.7 The warranty stays with the device. If you sell or give the device away, the new owner can claim using the original order number.

9. Your statutory rights
9.1 Nothing in these Terms affects your rights under the Consumer Rights Act 2015. Products must be of satisfactory quality (taking into account that they are refurbished and sold under a stated grade), fit for purpose and as described.
9.2 In particular, if a product is faulty:
- within 30 days of delivery you may reject it for a full refund;
- within 6 months you are entitled to a repair or replacement; if that fails or is not possible, a refund. The fault is presumed to have existed at delivery unless we prove otherwise;
- for up to 6 years (5 in Scotland) you may claim a remedy if you can show the fault existed at delivery.
9.3 Where our 24-month warranty and your statutory rights overlap, you may rely on whichever is more favourable to you.
10. Our liability
10.1 We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. We are not responsible for loss that is not foreseeable, for business losses, or for loss caused by your breach of these Terms.
10.2 You are responsible for backing up and removing personal data from any device you return to us. We are not liable for data left on a returned device, although we erase all returned devices as standard.
10.3 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights, or for anything else that cannot be limited by law.
11. Business customers
11.1 If you order as a business (you provide a company name or VAT number, or tell us the purchase is for business use), the cancellation right in section 6 does not apply and the Consumer Rights Act rights in section 9 are replaced by the implied terms of the Sale of Goods Act 1979. The 24-month warranty in section 8 still applies.
11.2 Our total liability to a business customer for any order is limited to the price paid for that order.
12. Governing law and disputes
12.1 These Terms are governed by the laws of England and Wales.
12.2 If you have a complaint, contact us at [email protected] or by WhatsApp chat (+44 7913 170620, 9am to 9pm UK time). We acknowledge complaints within 2 working days and aim to resolve them within 14 days; you can ask for escalation to a manager, who will respond in writing within 10 working days.
12.3 PhoneMart is not a member of an alternative dispute resolution scheme. You may obtain free, impartial advice from the Citizens Advice consumer service (0808 223 1133).
12.4 You may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also use the courts of the country where you live.
